2009/2010 Road RulesChild Resraint Evaluation Program

All States and Territories in Australia have agreed to adopt a new set of laws regarding the use of child restraints in motor vehicles.

The new laws as recommended by the National Transport Commission are as follows;

Children aged under six months must wear an approved, properly fastened and adjusted, rear-facing child restraint.

Children aged between six months and under four years must wear an approved, properly fastened and adjusted, rear facing child restraint OR a forward facing child restraint with an in-built harness.

Children aged between four years and under seven years must wear an approved, properly fastened and adjusted, forward facing child restraint with an in-built harness OR an approved booster seat which is properly positioned and fastened.

As the laws are state based, they may slightly differ to these recommendations and one another, so we suggest you use the relevant links below to get the correct information for your state.

Victoria
Victoria will be enforcing the new laws from November 9th, 2009.

Tasmania
Tasmania is using a staggered implimentation. The Department of Infrastructure, Energy and Resources has advised us that the rules for children under four years will be enforced from December 1st, 2009. The rule for children between four years and under seven years will be enforced one year later, December 1st, 2010.

Queensland
Queensland will be enforcing the new laws from March 11th, 2010.

South Australia
South Australia does not yet have a confirmed date for the enforcement of the new laws. Their website states 'the new laws will come info effect around mid 2010'.

New South Wales
New South Wales will be introducing the new laws from March 1st, 2010. There will be a 4 month period after that date for people to comply, after which the new laws will be enforced by the Police.

Australian Capital Territory
The ACT does not yet have a confirmed date for the enforcement of the new laws, however, the Department of Territory and Municipal Services advised the laws would be implimented this year (2009).

Western Australia
Western Australia does not yet have a confirmed date for the enforcement of the new laws, however, the Western Australian Office of Road Safety has advised that the laws "will come into effect in the first half of 2010".

Northern Territory
The Northern Territory does not yet have a confirmed date for the enforcement of the new laws.
